business dealings of its Users) and the means by which Barter of
America.com will safeguard such privacy.

As part of the normal operation of our services we collect and,

prepared a detailed policy because we believe you should know as
much as possible about Barter of America's practices so that you
can make an informed decision.
If at some point in the future, there is a change to our information
usage practices that affect your Personally Identifiable Information,
we will notify you by email (if we have your email address) of the
relevant changes. At the time of this message, you will be able
to opt-out of this information usage by sending a message to the

this posted Privacy Policy for changes. Any changes are effective
after we provide you with at least ten (10) business days' notice
of the changes by posting the changes on our web site and sending
email to clients who select such notification.
As described below, some of your personally identifiable information
is disclosed to third parties and used by third parties and us.
By accepting the Barter of America Client Agreement, you expressly
consent to our use and disclosure of your personally identifiable
information as set fourth in this policy. This Privacy Policy
is incorporated into and subject to the terms of the Barter of America
Client Agreement.

1. Information We Collect
1.1 Our primary goal in collecting personal information from you
is to provide you with a smooth, efficient, and customized experience
while using our services. This allows us to provide services and
features that are aimed at meeting your needs, and to customize
our service to make your experience easier and quicker.
1.2 To fully use our services, you will need to register using
our registration form, on which we require you to provide us with
your contact information and financial information. We require additional
information including billing address, credit card information,
taxpayer ID, bank account information, etc. to assess your qualifications
for registration.
1.3 As part of the client registration process we ask for your
company information as well as certain personal information like
name, address and credit card information. Based on what you provide
us, we request credit-reporting agencies to provide us information
about your business and your personal credit history when necessary.
This not only helps us process your application efficiently and
provide superior service, but also protects our existing members
by potentially preventing businesses, which do not meet our quality
standards from joining the exchange. Moreover, authorized and trained
personnel handle the information that is collected.
1.4 We automatically track certain information about you based
upon your behavior on the Barter of America Network. We use this
information to do internal research on our clients' demographics,
interests, and behavior to better understand and serve our clients.
This information is compiled and analyzed on an aggregated basis.
This information may include the URL that you just came from (whether
this URL is on our site or not), which URL you next go to (whether
this URL is on our site or not), what browser you are using, and
your IP address.
1.5 If you choose to buy or sell on the Barter of America Network,
we collect information about your buying and selling behavior.
1.6 If you send us personal correspondence, such as emails or letters,
or if other clients or third parties send us correspondence about
your activities or postings on the Barter of America Network, we
may collect such information into a file specific to you.
1.7 The Barter of America web site uses per-session cookies to
enhance search and browse functionality. If you disable cookies
per-session cookies, certain search and browse functions will not
be available. Per-session cookies are not used to record Personally
Identifiable Information.
2. Our Use of Your Information
2.1 We use personally identifiable information about you to improve
our marketing and promotional efforts, to statistically analyze
site usage, to improve our content and product offerings and to
customize Barter of America's content, layout, and services. We
believe these uses allow us to improve the Barter of America Network
and better tailor it to meet our clients' needs.
2.2 We use your email address, your mailing address, and phone
number to contact you regarding administrative notices, new product
offerings, and communications relevant to your use of the Barter
of America Network. If you do not wish to receive these communications,
you have the ability to opt out.
2.3 If you choose to conduct trades on the Barter of America Network
or open a credit account, we use your address and billing information
to bill you and provide associated support.
2.4 We use information in the file we maintain about you, and other
information we obtain from your current and past activities on the
Barter of America Network, to resolve disputes, troubleshoot problems
and enforce our Client Agreement. At times, we may look across multiple
clients to identify problems or resolve disputes, and in particular,
on rare occasions, we may evaluate your information to look for
clients using multiple Barter of America card numbers or aliases.
2.5 We use your information to assess your credit worthiness.
3. Our Disclosure of Your Information
3.1 As a general practice, we do not sell or rent any personally
identifiable information about you to any third party. The following
describes some of the ways that your personally identifiable information
may be disclosed.
3.2 The Barter of America Network. Throughout the Barter of America
Network, clients can search and view information on other clients,
including business name, contact name and contact information. As
a result, other clients and third parties might send you unsolicited
correspondence and be able to identify your activities on the Barter
of America Network. We also provide a number of ways to find more
out about you and your site activities, such as viewing all of the
goods and services you are offering at the time.
3.3 Legal Requests. The Company cooperates with law enforcement
inquires and other third parties to enforce laws, intellectual property
and other rights. Therefore, intellectual property and other rights
owners, and local, state, federal and international law enforcement
can request and may receive your personally identifiable information.
3.4 Credit Reporting Agencies. We may disclose your information
to credit reporting agencies.
3.5 Suppliers and Other Service Providers. We may use third party
Suppliers and Service Providers to facilitate our services. For
example, we may outsource the operations of one or more aspects
of the Barter of America Network to a Supplier or Service Provider
who performs services according to our requirements. In some instances,
the Service Provider may collect information directly from you (such
as the situation where we ask a Service Provider to conduct a survey
for us). In these cases, you will be notified of the involvement
of the Supplier or Service Provider, and all information disclosures
you make will be strictly optional. In all cases, we restrict how
these Suppliers and other Service Providers may access, use and
disclose your information. We do not permit these Suppliers and
other Service Providers to sell your information to third parties.
3.6 Due to the existing regulatory environment, we cannot ensure
that all of your private communications and other personally identifiable
information will never be disclosed in ways not otherwise described
in this Privacy Policy. By way of example (without limiting the
foregoing), we may be forced to disclose information to the government
or third parties under certain circumstances, or third parties may
unlawfully intercept or access transmissions or private communications.
We can (and you authorize us to) disclose any information about
you to law enforcement or other government officials as we, in our
sole discretion, believe necessary or appropriate, in connection
with an investigation of fraud, intellectual property infringements,
or other activity that is illegal or may expose us to legal liability.
Further, we can (and you authorize us to) disclose your name, street
address, city, state, zip code, country, phone number, email, and
company information as we in our sole discretion believe is necessary
or appropriate in connection with an investigation of fraud, intellectual
property infringement, piracy, or other unlawful activity. Therefore,
although we use industry standard practices to protect your privacy,
we do not promise, and you should not expect, that your personally
identifiable information or private communications will remain private.
4. Your Use of Other Clients' Information
4.1 In order to facilitate interaction among all Barter of America
clients, our service allows you to access other clients' contact
information. Further, as a seller you will be sent via email or
by other online means the Barter of America card number, email address
and other information of the interested buyer(s), and as a buyer
you will be sent via email the Barter of America card number, email
address and other information of the seller.
4.2 By entering into our Client Agreement, you agree that, with
respect to other client's personally identifiable information that
you obtain through the Barter of America Network or through a Barter
of America-related communication or Barter of America-facilitated
transaction, you may use such information only for: (a) Barter of
America-related communications that are not unsolicited commercial
messages, and (b) any other purpose to which such client expressly
consents after adequate disclosure of the purpose(s). In all cases,
you must give clients an opportunity to remove themselves from your
database and a chance to review what information you have collected
about them. In addition, under no circumstances, except as defined
in this section, can you disclose personally identifiable information
about another client to any third party without our consent and
the consent of such other client after adequate disclosure.
4.3 Barter of America and our clients do not tolerate Spam. Therefore,
without limiting the foregoing, you may not add a Barter of America
client (even a client who has purchased an item from you) to your
mail list (email or physical mail) without that client's express
consent after adequate disclosure.
4.4 This web site contains links to other sites. This statement
is for the sole use and purpose of Barter of America. Please be
aware that Barter of America is not responsible for the privacy
practices of such other sites. We encourage you to read the privacy
statements of each and every web site that collects your personally
identifiable information.
5. Control of Your Personal Identification
Number (PIN) or Password.
5.1 You may not disclose or share your Barter of America PIN (also
known as "password") to or with any third parties. If
you lose control of your PIN, you may lose substantial control over
your personally identifiable information and may be subject to legally
binding actions taken on your behalf. If your PIN has been compromised
for any reason, you should immediately change your PIN.
Access to your account is password protected
Access to your personal account on-line is password protected.
We will NEVER release your account password to any third party,
unless required by law. In the event that you forget your password,
you may generate an on-line request to have the password sent to
you by e-mail at the e-mail address used for registration.
6. Reviewing and Changing Your Information
6.1 Following registration, you can review and may be able to change
the information you submitted during registration including:
- Your name, company, taxpayer ID, address, city, state, zip code,
country, primary phone number, secondary phone number, fax number
- Your PIN
- Your credit card number and expiration date
6.2 You must promptly update your information if it changes.
6.3 In responding to a request to have your personally identifiable
information removed from our databases, you should not expect that
all of your information will be completely removed. In some circumstances,
we will maintain your information in order to resolve disputes,
troubleshoot problems and enforce our Client Agreement. Furthermore,
technical constraints (related to database architecture and programming)
prevent us from completely removing such information.
7. Other Information Collectors
7.1 Except as otherwise expressly discussed in this Privacy Policy,
this document only addresses the use and disclosure of information
we collect from you. To the extent that you disclose your information
to other parties, whether they are buyers or sellers on our system,
different rules may apply to their use or disclosure of the personal
information you disclose to them. Since Barter of America does not
control the privacy policies of third parties, you are subject to
the privacy customs and policies of that third party. We encourage
you to ask questions before you disclose your personal information
to others.
7.2 How we store information
Information is stored at a physically
and electronically secure data center or centers. This center or
centers may be located inside or outside the European Union and
North America. Direct access to this database is restricted to authorized
BarterofAmerica.com staff and their appointed agents. BarterofAmerica.com
has taken every reasonable step to ensure that your information
is held securely at all times. What else we may do with the information
we gather
We may, from time to time, perform analyses or request
third parties to perform analyses on our behalf on all or part of
the transaction data, including personal information, held by us
on all or some of our personal account holders and traders.
8. Security
8.1 Barter of America uses industry standard efforts to safeguard
the confidentiality of your personal identifiable information, such
as firewalls and Secure Socket Layers. However, "perfect security"
does not exist on the Internet.
